These Terms of Service (these "Terms") set out the conditions for using the notes app "Nokosu" (the "Service") provided by the Nokosu team ("we"). Please use the Service only after agreeing to these Terms.
Article 1 (Application)
These Terms apply to all relationships between users and us concerning the use of the Service.
Article 2 (Registration)
The Service can be used without registration. By downloading and launching the Service, you are deemed to have agreed to these Terms.
Article 3 (Prohibited acts)
When using the Service, you must not engage in any of the following:
- Acts that violate laws or public order and morals
- Acts related to criminal activity
- Analyzing, copying, or modifying the source code of the Service
- Acts that may interfere with the operation of the Service
- Gaining or attempting to gain unauthorized access
- Any other act we deem inappropriate
Article 4 (Suspension of the Service)
We may suspend or interrupt all or part of the Service without prior notice if we determine that any of the following applies:
- Maintenance, inspection, or updates of the systems related to the Service
- The Service becomes difficult to provide due to force majeure such as earthquake, lightning, fire, power outage, or natural disaster
- Any other case where we determine suspension or interruption is necessary
Article 5 (Paid subscription)
The Service's basic features are free to use. Some additional features are offered as an auto-renewing paid subscription, "Nokosu Pro".
- The price and any free trial period are shown within the App and on the App Store product page.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- The subscription term is one month, and it renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Renewal charges are billed to the same Apple ID.
- You can cancel at any time from the iOS Settings app → Apple ID → Subscriptions. If you cancel at least 24 hours before the next renewal date, you will not be charged for the following period.
- Refunds are handled in accordance with Apple's (the App Store's) policies. We do not process refunds individually.
Article 6 (Copyright)
Copyright in the notes, photos, and other content you create using the Service belongs to you. This data is, as a rule, stored on your own device, and we do not access its contents.
Article 7 (Disclaimer)
We make no express or implied warranty that the Service is free from de facto or legal defects. We bear no responsibility whatsoever for any damage arising to users from use of the Service.
Article 8 (Changes to the Service)
We may change the contents of the Service or discontinue providing it without notice to users.
Article 9 (Changes to these Terms)
We may change these Terms without individual notice to users when we deem it necessary. The revised Terms take effect from the time they are posted within the Service or on the website.
Article 10 (Governing law and jurisdiction)
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
